Terms and Conditions
**1. General Information**
This Regulation governs the use of the online store operated by Shopify, run by Plovi, NIP 7543366507, REGON 527653458, Aleja Jana Pawła II 27, 00-867 Warsaw, Poland (“Seller”), a company registered in Poland specializing in the sale of liposomal products. These regulations apply to sales within the European Union, the United Kingdom, and internationally.
**2. Ordering Process**
Orders can be placed through our Shopify online store (www.yourplovi.com), by selecting products and completing the purchase process. Our goal is to process all orders within 24 hours of receiving full payment. Payment processing occurs through the chosen payment method at the time of order. Current payment options include Stripe, PayPal, Tpay, and Przelewy24. The maximum order processing time is 30 business days.
**3. Prices and Payments**
All prices displayed in the online store include applicable taxes but do not include delivery costs. Accepted payment methods include:
- Credit/debit card/ Apple Pay/ Google Pay processed by Przelewy24 and Tpay
- Online payment systems such as PayPal
- Direct bank transfer
Payment must be completed before the shipment of products.
**4. Delivery**
Products are delivered to the address specified by the customer during the order process. Delivery prices vary depending on the country and destination. Customers are responsible for selecting the appropriate delivery option from those available on the site. We aim to dispatch orders within 48 hours to the EU, the UK, and other international locations within standard delivery times, but we are not responsible for delays caused by postal services or incorrect address details provided by the customer.
Local and international delivery times:
- Poland: Typically within 2-3 business days via Inpost
- EU and UK: The aim is to deliver within 5 business days, but please allow for the possibility of extension to 14 business days via UPS
- International: Delivery may take up to 14 business days via UPS
**5. VAT and Customs in the UK**
For orders sent to the UK valued over £135, to comply with UK tax regulations, orders may be split into multiple shipments. Each shipment will be priced below the £135 threshold to prevent the package from being detained for customs payment. Customers are responsible for any duties and taxes imposed on orders sent to the UK.
**6. Complaints and Returns:**
**Damaged products:** If a product arrives damaged, customers must provide photographic evidence of the damage within 3 days of delivery to qualify for an exchange or refund. This requirement is intended to prevent false claims concerning partially used products.
**Returns:** Customers have the right to return products within 30 days of receipt, provided that the products are unopened and in their original condition. Return costs are borne by the customer. Returns will be processed excluding delivery, administration, and payment processing costs and will be completed within 15 business days of receiving the returned items. The statutory rights of the customer remain unaffected.

**Right of Withdrawal:**
1. The consumer may withdraw from the Sales Agreement within 14 days without giving any reason.
2. The period for withdrawal begins from the delivery of the Product to the Consumer or a third party other than the carrier indicated by the Consumer.
3. In the case of an Agreement that covers multiple Products delivered separately, in batches, or in parts, the withdrawal period runs from the delivery of the last item, batch, or part.
4. The Consumer may withdraw from the Agreement by submitting a statement of withdrawal to the Seller. To meet the withdrawal deadline, it is sufficient for the Consumer to send the statement before the withdrawal period expires.
5. The statement may be sent by traditional mail or electronically by sending the statement to the Seller's email address or by submitting the statement on the Seller's website – the contact details of the Seller are specified in § 1 of the Terms. The statement can also be made using the form attached to the Act of 30 May 2014 on consumer rights, but this is not mandatory.
6. In the event of withdrawal by electronic means, the Seller shall promptly send the Consumer a confirmation of receipt of the withdrawal statement to the email address provided by the Consumer.
7. Consequences of withdrawal from the Agreement:
a. In the event of withdrawal from a distance Agreement, the Agreement is considered void.
b. The Seller shall refund to the Consumer all payments received from the Consumer, including delivery costs, without undue delay and no later than 14 days from the day on which the Seller was informed about the Consumer's decision to withdraw from the Agreement, except for additional costs resulting from the Consumer's choice of a delivery method other than the least expensive standard delivery offered by the Seller.
c. The refund will be made using the same payment methods as those used by the Consumer in the original transaction, unless the Consumer expressly agrees otherwise, and in any case, the Consumer will not incur any fees as a result of such a refund.
d. The Seller may withhold the refund until the Product is received back or the Consumer has supplied evidence of having sent back the Product, whichever occurs first.
e. The Consumer should send back the Product to the Seller's address specified in these Terms promptly and no later than 14 days from the day on which the Consumer informed the Seller about the withdrawal from the Agreement. The deadline is met if the Consumer sends back the Product before the period of 14 days has expired.
f. The Consumer bears the direct cost of returning the Product, including the cost of returning the Product if, due to its nature, the Product cannot normally be returned by post.
8. If, due to the nature of the Product, it cannot be returned by normal postal services, information about this and the cost of returning the Product will be provided in the description of the Product in the Store.
9. The right to withdraw from a distance contract does not apply to the Consumer with respect to Agreements where the subject of the service is a thing delivered in a sealed package that cannot be returned after opening the package due to health protection or hygiene reasons, if the package was opened after delivery.
**Complaints:**
1. Complaints regarding the functioning of the Store and related to the use of services provided electronically by the Seller can be submitted:

2. Complaints will be considered no later than within 14 days from the date of their receipt by the Seller. The response to the complaint will be sent to the email address provided in the complaint or to the postal address provided by the Customer.
**Additional Rights and Out-of-Court Complaint and Redress Mechanisms:** Detailed information on the consumer’s options to use out-of-court methods of complaint resolution and claims enforcement, as well as the rules for accessing these procedures, are available at the offices and on the websites of district consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Provincial Inspectorates of Trade Inspection, and at the following online addresses of the Office of Competition and Consumer Protection:

Consumers have the following sample options for using out-of-court complaint resolution and claims enforcement methods:
a. Consumers are entitled to approach the permanent amicable consumer court, as mentioned in Art. 37 of the Act of December 15, 2000, on the Trade Inspection (Journal of Laws of 2014, item 148 with later amendments), with a request to resolve a dispute arising from the Agreement concluded with the Seller.
b. Consumers are entitled to approach the Provincial Inspector of Trade Inspection, according to Art. 36 of the Act of December 15, 2000, on the Trade Inspection (Journal of Laws of 2014, item 148 with later amendments), with a request to initiate mediation proceedings to amicably conclude a dispute between the Consumer and the Seller.
c. Consumers can also obtain free assistance in resolving a dispute with the Seller, including free help from the district consumer ombudsman or a social organization whose statutory tasks include consumer protection (e.g., the Consumer Federation, Polish Consumer Association).

The online store complies with GDPR regulations. Customer data collected during the ordering process is used solely for processing orders and is not shared with third parties without explicit consent.
**11. Intellectual Property**
All content on the Online Store, including text, graphics, logos, and images, is the property of the Seller and is protected by international copyright laws. Unauthorized use of any materials is prohibited.
**12. Governing Law**
These Terms and Conditions are governed by Polish law, and any disputes will be subject to the exclusive jurisdiction of the Polish courts.
**13. Changes to the Terms**
The Seller reserves the right to change these terms and conditions at any time. Customers will be notified of significant changes through the Online Store or email.
